At least that's what happened with one of my mates who had third party fire and theft with NRMA.

Re: Operation repair
Same thing happened with my mate, got rear ended by a commonwhore who didn't have insurance. NRMA repaired my mates car and went after the other guy for funds.
Do you have proof that the other guy hit you? As in a written statement from the time of the crash, or witnesses?

Re: Operation repair
no third party only covers someone elses car not mine. Also the guy infront of me had a scratch on his i30 from me being pushed into the back of him by the guy behind me

Re: Operation repair
I don't know if NRMA has changed it since a couple years ago. But it used to be third party covered you for market value if someone else was at fault.

Re: Operation repair
No witness and everyones written a statement but the NRMA has them. The guy infront of me is saying he didnt see me get rear ended but only felt me hit him so they chose to pin that on me and say i hit him then got hit from behind even though i stopped in timeVectose wrote:Same thing happened with my mate, got rear ended by a commonwhore who didn't have insurance. http://www.nrma.com.au/car-insurance/th ... urance-nswCover of up to $5,000 if your vehicle is damaged in a crash with an at fault driver
It used to be 10k.
Did the driver that hit you sign a statement admitting he was at fault?

Re: Operation repair
You need a solicitor if you want to fight it...
Old mate will say that he hit Jaz after she hit the other car. So she will be liable for her damage to the front of her car, and the car she hit.
Old mate will be responsible for the rear end damage. He will claim he is poor, doesn't have insurance, and a long winded legal battle will take place. You will end up paying thousands in fees, to recover a small amount, that he won't pay anyway. Maybe you will be lucky to get $0.10 to the $1 as he will claim "financial hardship".
All in all, you will lose thousands...

Re: Operation repair
Get back on to NRMA, my step had a prang in the exact same manner.
NRMA offered him a premium excess, to which he paid, was another $600 odd bucks, the car was then repaired immediately (in your case written off & full value paid out to you), then NRMA on their own time went after the at fault driver.
You have to remember, the insurance company will do EVERYTHING in their power NOT to pay the claim. They came back to you & said no - you just rolled over & accepted it. Go back and fight it, but be smart about it.
Advice from my misses who just fought & won over our claim:
- Ring up NRMA & pretend to be someone else, just ask for general advice
- Ask about the premium excess senario I mentioned above
- Ask them where in the PDS it states the reason why you were knocked back - I guarantee it wont be there.
- Take contemporaneous notes when you do. Note the time, date, and name of the person you spoke to
- Send in your complaint in writing stating all these facts.
- In your complaint ask why the reason for your knock back isnt in the PDS
- Ask how you could have made an informed decision as to taking out the policy, when all the information wasn't disclosed to you.
The more holes you can poke in their story the better. It'll go to their legal team, you may have a bit of to & throw with them, but stay firm.
Last of all, take the emotion out of it, they don't give a sh*t about your financial hardship, just state the facts.
