Oh & if you want to go down the repair path, take at look at my thread here.

So far, $500 odd bucks in new parts from Japan, about $500 in second hand parts from club members. Plus this prang is worse than yours.

Advice from my misses who just fought & won over our claim:
- Ring up NRMA & pretend to be someone else, just ask for general advice
- Ask about the premium excess senario I mentioned above
- Ask them where in the PDS it states the reason why you were knocked back - I guarantee it wont be there.
- Take contemporaneous notes when you do. Note the time, date, and name of the person you spoke to
- Send in your complaint in writing stating all these facts.
- In your complaint ask why the reason for your knock back isnt in the PDS
- Ask how you could have made an informed decision as to taking out the policy, when all the information wasn't disclosed to you.

The more holes you can poke in their story the better. It'll go to their legal team, you may have a bit of to & throw with them, but stay firm.
Last of all, take the emotion out of it, they don't give a sh*t about your financial hardship, just state the facts.
But she doesn't have comprehensive insurance... Nor does the guy who hit her... So a different case..

Her policy is Fire/Theft and third party ... So since none of that applies in this case, then they will not pay her anything. If the other bloke just has compulsory third party, and no comprehensive, then his cover is for property damage... Not damage to others...

So she has to chase him for any cash. And since she has not paid a "premium" to an insurance company, they are not going to fight for her, as they have not got a cent out of her, or never will get one out of him...

That's not true. Go ask Rhys, he got hit, not at fault, he only had Fire/Theft with NRMA, other driver denied fault, then wouldn't pay. Rhys paid the premium, NRMA did the rest.

And it was your insurance mate that gave us this advice ;-)

He's been very handy I must say :lol:

Was one of his industry mates that gave us the advice on Conor's prang too, the one where he wasn't a named driver. We've won on both occasions now.

Oh & he said to say G'day to you last time I spoke to him :lol:

Yeah, I keep meaning to meet up with him for lunch .. But given I am out at bloody Camden, I never get a chance to say g'day ...

Top bloke though .. And his list of contacts are just amazing... He really is at the top of his game.. And such a decent person too .. Which is always good...

Try and get the PDS of you insurance... See if it has the clause like Ben quoted above... Then all you have to do is prove his guilt.. And him hitting from behind kind of does do that.. But yeah, may have to play a bit of hard ball ..

And if she has front end damage in a rear ender, old mate may not be "entirely" at fault

I've got $50 on the fact no call to NRMA will ever be made & we'll be back here in a month with the seagulls parting out the car :lol:
