busted for speeding...again

I keep getting busted..

This time by a radar guy...doing another quality 10kmph over the limit...this take me over the 12 demerit points limit. Unfortunetly it was 1 day before 3 points expire which would have made me still under...1 day! anyway we will see whats happens but I assume the worst.

I'm thinking of two options...delay and court...or cope is sweet. I can opt of the 12months with no fine stuff but it seems very unlikely for me..so I might go 4 months without a licence and get my points back to 0...move into the city for a bit and let my wife drive me around for a few months...oh no dunno whats worse...

haha so options please on this very serious matter...whihc probably wont happen for another 3months...I will send some letters asking for details which will delay the enevitable.....

I was thinking court will cost me about 3-4k if I loose...which would be 1-2 monts (half) of the rent of a apt next to work...so I'm thinking no driving for a peroid of time...all the cars go into the garage :(

Also seeking legal advise from some1 in the know...

For all u yougsters out there...dont speed...it sux..

Hey how does this whole license suspension thing work as i got busted speeding two weeks ago and the cops said your license is going to be suspended? Is it already suspended? If not am i still able to drive?

lol so have you learnt your lesson about speeding yet?

been there, done that ... just don't do what i do before, got caught driving after suspended. I wouldn't waste money going to court without a good reason though 8O

topao you should get a letter send to your address telling you when your the suspend date will start.

how fast were u going over the limit? usually 30+ is a 6-12 months loss of licence

48 over the limit the limit was 110 my limit is 90 red p plater :) so i was going 138 he was a nice cop and said he would give me 3months suspension and the fine, its my first offence.

how long does it normally take for the letter to come?

yeah but they are effective from the date of the offence..so I'm still screwed

my only hope is that they calulate them wrong...ie. not as they say they do...I dont think I'm in luck....

Might just have to drive slow for 12 months...kinda sucks :?

I plan to delay this for a while with some letters, some intresting concepts out there from some vic freedom fighters...I doubt I can beat the charge but I can sure delay it as long as I can... :P

I take it you were stopped and asked to produce you're license in which case you're screwed. If it was a camera or have a recent camera offence you havn't paid you can always get someone else to take tha credit, $500 perpoint is the going rate (never let you're granny hand in her license even if she sells the car and no longer drives, that's what Grannys are for)but for you it looks like delay, delay, delay and don't open any mail with a coat of arms for six months. Thats what I did and found my license had been suspended and reinstated and I was back to zero, so for $500 a point I'm your man

lol so you simply did not open mail for 6 months?

times like these im happy i drive like a granny.. im so paranoid, if there's a ford or a holden next to me, i'll stay 2 kms under the speed limit until he drives by me and i can turn my head and take a look if its a cop or not!

anyway.. i feel for u man, once u get the habit of driving over the speed limit, u cant help but do it... hope its not TOO bad for ya :?

I suggest you read;

You can apply to go to court to fight your ticket, and cancel your court appearance later if you decide not to go ahead with it (Pay a summons fee of $70)

There are other conditions that can be used to fight your ticket which I didn't find on that site;
If the Radar was operating in the rain/fog/other conditions
If there were other cars in view of the radar when you were pulled over. (Draw diagrams to show where the other cars were in relation to you and the radar if you're using this is your defence)
If the radar cop was hiding, or if there were other obstacles in the path between you and the radar cop.
Check the ticket for inconsistencies, if the cop put the wrong date or time on the ticket, you can get off on a technicality.
If the cop doesn't show up in court on the day you're meant to appear, I've been told you get the ticket cancelled.

An excerpt from the site.
* "CAMERAS are not to be set up on bends.
* OPERATORS must not camouflage or disguise the cameras in a way that could lead to a public perception of "sly operations".
* CAMERAS can be used on a downhill road only if the road has a significant history of speed-related accidents.
* TOLERANCE levels, where motorists can travel over the speed limit without being fined, are flexible.
* POLICE book so many people to reinforce the message that it is not worth the risk to speed.
* THE locations of fixed speed cameras are chosen to maximise the number of people who can be caught speeding.
* CAMERAS must not be set up within 200m of a change to the speed zone.
* CAMERAS can be used within 200m of a change to the zone in a children's crossing area or a school zone with prior approval of senior police."

The book also states. "Cameras should not be set up on or near an overpass, or facing an elevated adjacent road that may carry traffic past the extended speed camera radar beam.

Other sources of reflection are pole-mounted electricity supply transformers, metal signs such as house-for-sale or auction signs and Armco road barriers.

Metal bus stop shelters, public telephone booths, Australia Post letter-boxes, sheet metal garage doors, fences, factory walls and closely spaced iron picket fences are listed as possible reflectors capable of distorting speed readings."
This is probably the most comprehensive lot of information you will find on the topic in any one place. Follow the links to the other sites and read what they've got to say as well.

I would also suggest travelling back out to the site where the cop was parked, and suss out his line of sight to you, where you would have been when he got you with the radar.

Also, some other advice if you end up going to court to fight the ticket;

Make sure that you turn up EARLY, try and be the first one there in the morning, lined up out side the court building to be the first person to see the judge. This will make you look better, and also the judge would be more likely to be in a worse mood the more people he has to deal with during the day. So schedule it for the first thing in the morning if possible.

Try to recall your conversation with the cop when he pulled you over, because he most definately did! If you admitted to speeding when he pulled you over, he will have that on record, and use it against you in court. You really should write everything down immediately after the cop has gone, and whenever you are pulled over by a cop, ask them what you have done wrong and do not admit to anything, if you can, deny committing the offence that they said you did, and POLITELY ask for proof (radar reading) or indicate that the radar must have picked up someone else, because you were constantly checking your speed and didn't go over the limit - But NEVER be RUDE to the officer.


Thats aobut all the advice I can give you, but if you're serious about fighting your ticket, send me a pm, I will try and find the document for the Radar Standards in Australia - It has to be out there on the net for free somewhere, rather than paying $60 for it.

So would you say that if it was to say on my speeding ticket that i drove a sedan when really FTO is a Coupe right, would that get me off??? also under given names it does not state my middle name which is clearly displayed on my license between my first and last name, IS this enough to get me out of my suspension????? LOL still got a week left to pay the fine so a quick reply would be much appreciated :D

Oh wait he also hasnt filled in my card number surely this is enough to get me out of it right???? Lol

Drive like a Granny for 12 months, its easy to do once ya get use to it!

You dont have a legit excuse for being there.

You did the crime, you gotta pay. You go waste a Magsitrates time for nothing, it will probably backfire on you.

But if you decide to go ahead with Court, I'll be able to set you up with a Lawyer.
