I got a fine for my FTO ... and they sent me home the fine for "disobey stopping" ($189)

Weird thing is ... why didnt the police came to the car and hand me the fine?
Also ... i researched the RTA site and googled the rule i broke, it wasnt on the NSW RTA site ... like there isnt such thing as "disobey stopping"

Help guys! should i not pay the fine? pay the dam fking 190bucks? or FIGHT IT?

Personally i would go into a police office and ask them what this means. Then go from there

Definately fight it. A lot of people are intimitated with walking into a police station, but just go and ask them. Btw, do you know any instance where you could have been fined ?

Ran any stop signs or red lights recently? Pretty weak of them to pull that on an L plater, I feel.

Well it wont affect my record since if im not going to pay the fine ... it will be my mum. But the fine didnt mention any demerits. When i checked the RTA site on traffic fines it included a 2 point deduction.
Main concern is the specified fine doesnt even exist + why didnt the cop come up to the car and ask whats going on? if you get me.

i have an idea on how i may of gotten the fine .. i pulled over and had my hazards on at a post box loading zone to take off a plastic bag trapped in my front grill area and picked off some leaves and re position my L plates (parked for about 90 seconds max)

and THANKS for the help guys <3

Um was it the Police that Got you or a Parking Officer? Did the Fine come from the RTA or the Police?

Im not sure it is for stopping in a loading zone, by law arent you allowed to stop for 5 mins to drop off/pick up someone or obviously in the case of an emergency ? or is that for no standing areas ?....either way you can fight it, just say you were fixing you L plates and didnt want to get a fine for not displaying them correctly.

loading zones are for trucks or ppl with a delivery for the shop that the area is set aside for, you can not stop there for any amont of time .
Just think if a truck had to use that area he can drive right over you crushing your car and still be in the right and there is nothing you can do about it 8O

But still, no one has the right to damage your property, even if you are doing the wrong thing. but still i would fight it. If they dont have a photo of your car in the place then they cant really prove it, can they ?

Not really the way things are working now days mate. If your doing the wrong thing you'll more than likely be told to wear it. On the photo and evidence side of things most of these traffic laws (especially the newer anti-hoon laws) are completely up to the officers discretion, if they are having a bad day so, probably, will you. If you do get a court date for any of this stuff no days the best bit of advice I have heard is get a soliticor.

Unfortunately this isn't how things work.

They don't need a photo of your car to prove it, it's the officer's word against yours.

As sad as this sounds, there's nothing the OP can really do about it. Sure, you can ask the station what it's for and write a letter claiming you didn't deserve to be fined, but at the end of the day it's basically - Were you parked in a no stopping area? Yes.

As far as they're concerned, if the cop who fined you said you were, then it means you were. They're not exactly going to believe that a cop found it amusing to write you a phony fine, regardless of it being a fact or not, it's the officer's word against yours.

As pathetic as it sounds, save yourself the headache and tension, pay the fine and get it over and done with. Either that or expect yourself to pay 10x the amount of the fine on court fees for a slight chance of victory simply for your moral values.

+1

Sorry if I got anyone confused, in this case and especially as your Mum is willing to wear it I'd just pay the fine. Aren't Mum's great ;)

But in more serious cases when you are given a court date for something from everyone I've heard of it seems more than worth it to pay a solicitor.
