Please help!!! totaled lost FTO dunno what to do..

Hi everyone~..
i have owned my FTO for 2 years or maybe more, last year lend it to my bf (ex-bf) and he a truck crashed into the back of my fto baby and it's now totaled lost

it has been sitting outside my garage for more than half a year because i was waiting for the insurance company to give me directions, just in case they need to see the car, but recently found out the truck's insurance company isn't accepting the claim because they think my ex-bf has cause all the hazzard in the first place..........
and what make it worst..... i don't have any kind of insurance beside green slip... yes... funny eh? thanks to ex-ex bf,he didn't know green slip is different to third party....
well now going thru everything myself, getting legal aid and hoping i can sell the totaled fto asap and good price so i can at least get a sh*t box to get around.... public transport is giving a big headache...

so here i am scream for help, hoping someone is able to lend me a hand, show me what i can do and where i can sell the car for good price
nothing is wrong with the engine, just the back is pretty...... squashed
but i remember a front cut cost $3500 or something like that, so i was hoping i can see it for a good price....
please fellow fto pals (although practically i don't own one any more) please give me some advice

if you only had compulsory third party insurance (green slip) and the truck's insurance company doesn't pay up you're pretty much screwed :/. I hope you got a statement or something from the driver of the truck at the time.
even if you had third party property insurance, depending on the company, they would either not give you any money at all in the case of an uninsured driver hitting you, or in some cases they'll give you a small amount (e.g. $3000).

Maybe list it on ebay...get more people looking at it. Have you had it checked out or any reports?? whats the verdict?
I mean if it can be repaired....there are some options....probably best you get some idea of the damange..photos or even get some1 to inspect it and see how much damage it has.
If its only pannels...then should be ok to fix...if its more it will cost more..i.e. more than its worth..

that totally sucks!
unfortunately its you against the Insurance company.
3500.00 is a fair price for a wreck / half cut, i wouldn't go below that as a buyer is getting a lot more than a half cut. maybe check with a wrecker and see if they're interested.
oh and sorry but i can't resist if you want another fto mines for sale.

khunjeng said, why don't you find out how much it'll cost to fix? If it's worth getting it fixed, then you could even consider getting a small loan rather than selling off the car.
My friend's celica was hit once from behind, looked pretty bad but in the end it only needed to go to the panelbeaters and the lower back bar was broken on the inside so all up it only cost him a couple of gran to fix.
hopefully it's not as bad as it looks in your case

the back is not such a bad spot to be hit...cos there is not too much around there and its design to be hit in general...anyway I'm no expert...get some1 to check it out - if its not much to fix I will buy it and sell it

yes i am a lady fto driver

who happens to bump into many irresiponsible diXkhead bfs ... first one thought he was a expert in car but end up didn't get third party and crashed my car then i had to buy a front cut to fix it myself which cost me $8000 including other stuff such as labour, car towing etc. l
second one even worst... totaled lost my car..... not EXACTLY his fault but due to his fobby english, the statement he had with the police report was different to what exactly happened which is not making things easy.. and most importantly i have to get everything done by myself, like claim, tow truck, police, basically everything.... man... why are guys so irreponsible!!#@#

khunjeng allianz (truck dude's insurance company) has sent someone over and quoted that the car is total lost, he estimated i will PROBABLY need $27000 to fix it even though it was only the back but because i need to replace a little bit of the rear roof top as well (mmmm... i dunno how to explain it) so it's gonna be expensive.... maybe i should post up so fotos and have a look, i was full shocked and tears dropped when i saw the car
and yes i really thought i would be able to claim it all back as you guys probably agreed, when it's the rear is been hit it's 99% usually their wrong yea? trust me..... they are just trying to be slack to me cos i don't have third party......

so do u guys know any good wrekers? i don't even know where to search up for wrecks and man.... i really don't wanna get rodded as you know... being a chick ppl tends to scam you

Pictures? I find it hard to believe that what you've described could run a bill of more then 10k and be deemed as a wreck.
Also, the truck drivers in the wrong unless he takes you to court and can prove otherwise, that's just how it is because he was behind your ex.

Sorry to hear but why haven't you been more proactive in getting this sorted out? Six months is an awful lot of time for anything to happen.
With the damage what is was sounds like a police report should have been lodged - would have been useful also.
Have you got your own quotes for repairs?
Were there any witnesses to the accident?
Good to see you've contacted Legal Aid. The next step (I think) would be to send out a Letter of Demand...

i have actually went to legal aid and will be goin to this other legal aid again for more advice next week~.. sent out a letter of demand and now kinda waiting for reply but doubt they would pay me~ *finger cross* hoping i done have to go thru court cos it will take FOREVER...
i haven't got my own quote cos i am pretty sure it's a total lost, really should post up some fotos.... BUT i dunno how to post fotos here (still a newbie hehee)

i actually got the police report as soon as the incidence happened (bloody $80 i think) and the police report was not looking goood...

it showed both parties has resposibility and as i said... due to my ex's fobby english the statement he gave was not exactly what happened..... and becos the car was hit kinda on one side so it kidna showed he kinda swinged back as he was trying to merge into another lane ..........
and witnesss...... from what i know there was no witness BUT i heard from the tow truck driver the truck driver actually found a witness but i done even know where that witness come from....
everything is just not looking good...
oh yeah, the reason why i left it til so late cos the tow truck driver told me he is having a court case against the police for giving him a fine of not having enough safe gap, he didn't give me the insurance details until beginning of this year and the court case finally happened in MAY, but i dunno what's the result of it cos ever since the tow truck driver has not reply my calls and all....

hey i know this sounds really slack...
but if sh*t gets silly... go ask your ex for the money to fix it and if he refuses SUE HIM for the money... go to the court and slap a notice of demand on him

$27000??? They could build a brand new FTO from scratch for that!! I find that really hard 2 believe...

thats why i say slap the court case on the ex if the trucking company refuses to pay... u have the police report to say that he was at part fault... and since he was the driver he has to accept liability...
go to the court house and get a notice of demand sent to his house costs like $60... but you can get that reimbursed when you get payed out...
if that falls through...
me and sublime can always drop by his house and convince him...
but it wont get that far... because he'll hafta pay up at court...

haaha thanks guys~.. i have this really bad thing about asking ppl money back~.. and believe me many ppl has suggested me to slap a letter of Demand in my ex face, but i just didn't wanna go this far .... YET, although it has been a long while and he still hasn't done anything which totally PISSED me offf!!! but still... done want to have to get to the point i have to sue him
