In Victoria, if it was factory fitted it is perfectly legal, irregardless of auto focus. It's the aftermarket ones that people put into headlights designed for halogen globes that are illegal. They aren't focusable and dazzle the oncoming driver.
We have the glass projector lens so it's focusable, even then if it's an aftermarket kit, it's illegal.

There were numerous revisions on the laws over time, so it depends on when the car was complied and where.

Mine was imported just a few years ago and as such had the factory HID kit ripped out and sh*tty ass dodgy wired in crap globes of suckiness - but nothing i couldn't fix
